lame 3.94b broken gapless

Here is the original wav (royalty free sony demo content), an MP3 generated with lame 3.94b (lame -b 320 infile.wav outfile.mp3). The resulting file is water_394b.mp3. Noticeable glitch on adding this file several times to foobar play queue. If you run the Utilities -> Fix VBR header then the glitch is gone. The original unprocessed file plays fine though in the likes of xmplay and winamp.
