Creative Labs was sued in California over the misleading information that the Audigy 1/Extigy based soundcards supported 24bit/96000 sound processing. A settlement has been reached, and a 25 percent discount will be offered to anyone being able to prove that they are an owner of one of these soundcards. The only proof required to receive such a rebate is your soundcard's serial number.

Sadly as the case was brought in the States it only applies there, whats more many of the other countries do not have the legal framework for class actions, it is upto the individual to try for a refund (who is going to spend $xxxxx trying to get a $50 refund) or a government advertising watchdog to impose a fine which they would keep themselves.

This was so coming to them, they deserved it. Eventually their lies and misleading "creative" marketing will come back full circle and hit them right in the face.

If anything this means Creative will be keeping customers, and maybe even making a nice profit selling cards for suggested retail prices with modest discounts. What a joke.

The 25% rebate is for use with the purchase of another creative product, only available at www.us.creative.com

Doesn't look like they have the E-MU 0404 on there unfortunately...

But 25% off a Creative product? Just the deal with Aureal was enough to make me not buy another of those! smile.gif

This may demonstrate my severe lack of knowledge regarding the US judicial system, but if a class-action suit is settled, couldn't it be re-initiated by someone else? To settle a class-action suit seems unfair an the behalf of many of the consumers, especially when the gains are so negligible.

No kidding! We consumers lost this one. CL quite often offers rebate deals that are better than this--probably even less paperwork. sad.gif

When will Epson be sued for selling 24 bits 1200 DPI scanners advertised as 48 bits "2400 DPI true optical resolution" by a big red sticker on the box ?

No kidding. I assumed everyone had read that, and was naturally a bit perplexed by the enthusiastic response to this lawsuit-turned-advertising-campaign.

A settlement resulting in a rebate against the future sale of products for which the company was sued because of poor quality and misleading claims. Talk about a "catch".
