The plaintiff claims that Apple released a defectively designed product, because the display scratches too easily and excessively during normal use.

I wonder if it'll end like that absurd Creative court case. "get 25% discount in your next order at our online store"

If I cut newspapers for coupons, I would probably get a bigger discount :B

I got a black iPod nano a few weeks after it was released and I have to say that it scratches like crazy. A simple touch is enough to create scratches. Apple claims that the plastic material used for the nano is the same as that for the other iPods (except for the mini which is metallic) and I believe that this is indeed the case but the nano is supposed to be an ultra portable device which one carries in a pocket and therefore a better quality material should have been used.

Over the years I had several iPods and I was never happy with their built quality except for the iPod mini, the only well made and durable iPod ever made by Apple. For all the other iPods and especially the nano, the only solution to the problem of scratches is the following:

1. After opening the box, put the iPod in a soft case which covers the entire body
e.g. the Apple Tubes.

2. Find some transparent self-adhesive film like that used for mobile phones
and PDAs and stick it on the screen of the iPod.

3. Never, ever, take it out of the case. If you do, get some polishing liquid
(e.g. iClean) and work on it before putting it but in the case.

I hope the lawsuit is succesful and Apple switches back to materials used in the iPod mini for their entire iPod line. Even if that is going to slightly reduce the profits.
