Full Version: Bootleg Legality

If you tape a live show off the tv, and put it up on the web, is that legal? I'm not sure, considering its not commercially released material, and I would not make a profit in any shape or form. I live in the U.S., I'm not sure what the copyright laws for this are.

Thanks for any info you can divulge, any and all help is appreciated smile.gif

In most cases it would be illegal (except if the show specifically states it's uncopyrighted, but even something from PBS probably would be).

It probably is illegal.

Unlike some bands that encourage the free trade of live recorded music, the TV industry probably wishes to keep all that stuff. Mainly so they can create cool TV shows that run for two seasons and then cancel them and never do anythign with the footage, but in the even that they want to they still can.

Unless you're taping Dire Straits bootlegs, it is illegal in most cases. Someone once told me on the r3mix forum that Mark Knopfler's management, Damage Management, allows bootlegs as long as you don't make profit with them. Now, of which other successful band can you say that? biggrin.gif wink.gif
ssamadhi97
Dave Matthews Band.

you will find many more bands here...

I recall several years ago, pre-TiVo, there was a website in Canada, I believe, that was taping U.S TV shows and streaming them without the commercials on the net so you could watch them whenever you wanted. I don't remember if they were doing it for profit, but the networks sued and had them shutdown pretty quick.

We invite people to bootleg our shows. We invite people to...make CD copies....
we've no problems with that

I'm sure their label bosses have problems with that.

Actually, I was talking about an interview with Bono I read once.

Unfortunately, I don't remember where.

Edit: Blah, the same quote is transcripted at that site. biggrin.gif

Even if the rights owner of the show doesn't want money from it, you need his authorisation.

Did you all not see the link to btat (bands that allow taping) in my post above? There are a ton of bands that sanction taping (and trading of those recordings)...

Alot of the acts are a helluvalot more compelling tham U2 or Metallica, too...
