Maybe I'm tired this morning but I've just look at the AAC encoder from the last iTunes and what I see when I play my files in fb2k ?
SBR profile is enabled...
So I checked again and again the different settings for this AAC encoder. It seems that all target bitrates under
32kbps give this profile...Keep in mind that there is a resampling for lower values. Not bad, isn't it ?

On a related note, I've noticed that LC files encoded with the latest Nero encoder also show up SBR in Foobar (0.9.2). I just wrote this off as Foobar not properly reading something properly, but I'm not actually sure if this is the case. None-the-less, I know for a fact that the files I've encoded are LC, both because I'm using -0.5 and because they play on my iPod. With everything working fine I just decided not to worry about why it was happening, although I'm curious.
DickxLaurent; he is backcompatible, so they should play on ipod even if they are sbrish.

Indeed...So, SBR detection into foobar is not accurate.
@smok3: Yeh, but he's using -0.5 which should give him a bitrate of around ~170kbits. I doubt SBR is being used in that range.

If there's a he-aac codec available, Apple should've make an announcement somewhere.
iTunes encodes to 22050Hz, the decoder upsamples that and foobar thinks that it has SBR because of the upsampling.
