I really don't know what's better.
Nero Digital doesn't encode bitrates accurately, but Coding Tech AAC+ does.
Also Nero licensed AAC+ from Coding Tech.
What stereo mode Nero Digit uses? (MS Stereo or Strandard Stereo)

neroAacEnc does encode the bitrates quite accurately if you request (with -cbr) switch.
Default mode (-br) is "averaged bit rate", which has a bit of freedom. -cbr, however, conforms to ISO/IEC 14496-3 bit buffer requirements of "Constant Bit Rate" AAC.
Regarding licensing, Nero has its own AAC/AAC+/AAC+ v2 codec, completely unrelated to Coding Tech.

As a related note. Even though Coding Technologies holds a number of patents integral to implementing aacPlus, you can license the technology from the MPEG-4 Audio "patent pool" (managed by
Via Licensing and representing all appropriate patent holders, including CT)

But the result always is: 129 CBR LC.

Probably this is one of the problems arising from whether you assume 1KB = 1024B or 1KB = 1000B.
It's not. The CBR control is (was) not totally accurate, although the difference is never very big. In a next version this will be improved.
