I don't know if GNU/GPL protects against such abuse of patents usage, but if they don't, time to renew Ogg and Matroska (and their audio codecs, Vorbis and MPC)'s licenses...in order to make those codecs impossible to buy such rights, specially when those oportunists are roaming around there.
We are not talking of copyrighted music, that's other issue.
